Case 004/02

Case 004/02 concerned allegations against Ao An. The charges were severed from Case file 004 proper to avoid undue delays in the proceedings against Ao An while continuing the investigations in the remainder of Case 004.1

      JUDICIAL
      PROCEEDINGS

      The Co-Investigating Judges reached opposite conclusions on whether Ao An fell within the personal jurisdiction of the ECCC. The National Co-Investigating Judge dismissed the Case against him, while the International Co-Investigating Judge indicted him for various crimes. The Supreme Court Chamber terminated the Case due to the absence of a definite and enforceable indictment.

      Civil party applicants

      1,920 individuals applied for civil party status in Case 004/02. While the Case was eventually terminated, the information provided by these applicants is an important source of historical information about the Democratic Kampuchea period and the harm suffered by victims of the Khmer Rouge regime.
