Extraordinary Chambers shall be established in the existing court structure, namely the trial court and the supreme court to bring to trial senior leaders of Democratic Kampuchea and those who were most responsible for the crimes and serious violations of Cambodian laws related to crimes, international humanitarian law and custom, and international conventions recognized by Cambodia, that were committed during the period from 17 April 1975 to 6 January 1979.

The Supreme Court Chamber decides appeals brought by the accused, the Co-Prosecutors, or civil parties against decisions and judgements issued by the Trial Chamber.1 The Chamber may exercise both appellate jurisdiction and cassation over decisions of the Trial Chamber.2 The Chamber merges the functions of the Court of Appeal and Supreme Court of Cambodia which exist in the regular Cambodian judiciary.3 The Chamber is composed of four Cambodian judges (including the President) and three foreign judges. A supermajority of at least five judges must agree for a binding decision to be made by the Chamber.4

Trial Chamber
The Trial Chamber conducts trials of senior leaders of Democratic Kampuchea and those who were most responsible for the crimes and serious violations of Cambodian law during the period from 17 April 1975 to 6 January 1979.5 The Chamber decides whether an accused person is guilty or not guilty based on evidence, and witness and civil party testimonies presented during the trial. In exercising its trial jurisdiction, the Chamber broadly performs the functions of the Courts of First Instance which exists in the regular Cambodian judiciary. The Chamber is composed of three Cambodian judges (including the President) and two foreign judges. A supermajority of at least four judges must agree for an accused person to be convicted.6
