Martin Karopkin appointed as new international reserve judge in the Trial Chamber

Following the nomination by the United Nations Secretary-General Ban Ki-moon, and the approval by the Supreme Council of the Magistracy, His Majesty King Norodom Sihamoni has appointed Mr. Martin Karopkin (USA) as a new international reserve judge to serve in the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC).  He replaces Judge Claudia Fenz (Austria) who was appointed as an international judge in the Trial Chamber effective from 1 September 2014.

Case 002/02 trial to commence on 17 October 2014

The Trial Chamber has announced that evidentiary hearings in Case 002/02 against Khieu Samphan and Nuon Chea will commence on 17 October 2014 at 09:00. The Co-Prosecutors will be allowed to make a brief opening statement and the Accused will be given an oppurtunity to respond,before the first witness will be called to testify on Monday 20 October.

Case 002/02 trial to start with charges related to Tram Kok Cooperatives

The Trial Chamber has issued  a Decision on Sequencing of Trial Proceedings in case 002/02. Claudia Fenz appointed as new international judge in the Trial Chamber

Following the nomination by the United Nations Secretary-General Ban Ki-moon, and the approval by the Supreme Council of the Magistracy, His Majesty King Norodom Sihamoni has appointed Ms. Claudia Fenz (Austria) as a new international judge to serve in the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC). The appointment is effective from 1 September 2014. Judge Fenz has served as a reserve judge in the Trial Chamber since 2006, and she replaces Judge Silvia Cartwright (New Zealand) whose resignation takes effect from 1 September 2014.

Further Initial Hearing in Case 002/02 will be held on 30 July 2014

Following the Initial Hearing held in June 2011,the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) will conduct a further Initial Hearing in Case 002/02 against Khieu Samphan and Nuon Chea on Wednesday, 30 July 2014 at 09:00 in the main courtroom of the ECCC. Initial Hearing in Case 002/02 scheduled for 30 July 2014

The Trial Chamber has announced that an initial hearing in Case 002/02 against Khieu Samphan and Nuon Chea will be held in in the Main Courtroom of the ECCC on Wednesday 30 July 2014 at 09:00. If necessary, the hearing will continue on Thursday 31 July.

Judgement in Case 002/01 to be pronounced on 7 August 2014

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has announced that the judgement in Case 002/01 against Khieu Samphan and Nuon Chea will be pronounced at 09:00 am on Thursday 7 August 2014 in the ECCC main courtroom. If convictions are entered, decisions on sentencing and civil party reparation requests will also be delivered.

Khieu Samphan and Nuon Chea found fit to stand trial

In two separate decisions issued on 25 April 2014, the Trial Chamber found that both Khieu Samphan and Nuon Chea are fit to stand trial. The decisions were made after the two accused perssons had been examined  by three appointed medical experts in March 2014. The three experts appointed by the Trial Chamber were Dr. Seena FAZEL (United Kingdom), Dr. CHAN Kin Ming and Dr. HUOT Lina (Cambodia).

Trial Chamber defines scope for trial in Case 002/02

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has issued a new severance decision which defines which alleged crime sites and factual allegations will be included in the trial in Case 002/02 against Khieu Samphan and Nuon Chea. Charges related to genocide, forced marriages and rape, treatment of Buddhists, internal purges, targeting of former Khmer Republic officials, four security centers, three worksites and one group of adjacent cooperatives will form the basis for Case 002/02.

Adversarial hearing in advance of Case 002/02 evidentiary hearings to be held on 11 February 2014

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has scheduled an adversarial hearing at 09:00 on Tuesday 11 February 2014, to hear oral arguments on the scope of Case 002/02 and on the Khieu Samphan Defence Team’s request that Case 002/01 should be finally adjudicated before the evidentiary hearing in Case 002/02 commences. Should the hearing not conclude on 11 February 2014 as planned, it will continue on the following day.

Trial Chamber outlines way forward in Case 002/02

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia today issued a memo informing the parties to Case 002 of the next steps in the second phase of that trial. The memo, accompanied by a workplan highlighting the major stages and activities necessary prior to the commencement of the substantive hearing in Case 002/02, follows closely on last week’s decision of the Trial Chamber President not to establish a second panel to hear this phase of the case.

Case 002/02 to be heard by the current Trial Chamber panel

The President of the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia today issued a memo informing the Director of the Office of Administration that he is not recommending the appointment of a second Trial Chamber panel to hear the remaining charges in the second phase of Case 002.This follows on a recommendation from the Supreme Court Chamber that the President “avail himself of the existing possibilities” to form a second panel to try Case 002/02 with a view to expediting proceedings, which was discussed during last week’s Trial Management Meeting.

Trial Chamber to conevene a trial management meeting in Case 002/02

The Trial Chamber of the Extraordinary Chambers of the Courts of Cambodia (ECCC) will convene a trial management meeting in Case 002/02 against Khieu Samphan and Nuon Chea on Wednesday 11 December 2013 at 09:00.  The meeting will continue on Thursday 12 December, and if necessary also on Friday 13 December.The Trial Chamber has notified the parties that the following topics will be discussed during the meeting:

Closing statements conclude in Case 002/01

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) concluded 10 days of closing statements in Case 002/01 against Khieu Samphan and Nuon Chea on 31 October 2013. The Chamber will now withdraw for deliberations, and a judgment in this case is expected in the first half of 2014.

Schedule of closing arguments Case 002/01 adjusted

In a memo issued on 22 August 2013, the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia announced an adjusted schedule for closing submissions in Case 002/01. The deadline for written Closing Briefs by the parties is now extended by one week to 19 September, as the chamber has admitted into evidence about 2,000 more documents since it confirmed the original schedule on 24 July. The hearing of oral Closing Statements is revised to begin on 16 October at 9 am, instead of the previously scheduled date of 9 October.

Closing statements in Case 002/01 to commence at 9 October 2013

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has announced that closing statements in Case 002/01 will commence on 9 October 2013 at 9:00, and will go on until 22 October 2013. The Co-Prosecutors have been allocated three days, the Civil Party Lead Co-Lawyers one day and the defence teams for Nuon Chea and Khieu Samphan have been allocated two days each to present their closing statements. One additional day is reserved for rebuttal. The parties have been given until 12 September 2013 to file their written closing briefs. 

Trial Chamber issues reasoned decision on Case 002 severance

Today, the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) issued its reasoned decision on the severance of Case 002. This follows the oral announcement of the severance decision on 29 March 2013, enabling the trial to resume on 8 April, pending delivery of the written decision.

Supreme Court Chamber renders decision on appeal against scope of Case 002/01

On 8 February 2013, the Supreme Court Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) rendered its decision on an immediate appeal by the Co-Prosecutors against a decision of the Trial Chamber denying, in part, to expand the scope of the first trial in Case 002.

A tentative list of Case 002 hearings days for the remainder of 2012 is now available. Please note that this list is subject to any change deemed necessary by the Trial Chamber, and changes to the schedule may occur on short notice. Trial Chamber reduces number of weekly hearing days in Case 002/1

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) announces that effective from Monday 5 November 2012, it will reduce the number of hearing days and conduct proceedings Mondays through Wednesdays only.
