Case 002/02 to be heard by the current Trial Chamber panel

The President of the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia today issued a memo informing the Director of the Office of Administration that he is not recommending the appointment of a second Trial Chamber panel to hear the remaining charges in the second phase of Case 002.This follows on a recommendation from the Supreme Court Chamber that the President “avail himself of the existing possibilities” to form a second panel to try Case 002/02 with a view to expediting proceedings, which was discussed during last week’s Trial Management Meeting.

Mr. Bit Seanglim and Mr.So Mosseny assigned as defence counsel to represent two suspects in Case 004

The Defence Support Section (“DSS”) of the Extraordinary Chambers in the Courts of Cambodia (“ECCC”) has assigned Mr. Bit Seanglim and, separately, Mr. So Mosseny, as the Cambodian Co-Lawyers to represent two different Suspects named in the Third Introductory Submission submitted by the International Co-Prosecutor to the Office of the Co-Investigating Judges on 7 September 2009. The Third Introductory Submission is part of the Case File in Case 004.The identity of any Suspect named in the Third Introductory Submission remains confidential.

The Court Report for December 2013 issued

Nicholas Koumjian appointed as new international Co-Prosecutor

Following the nomination by the United Nations Secretary General Ban Ki-moon, and the approval by the Supreme Council of the Magistracy, His Majesty the King Norodom Sihamoni has appointed Mr. Nicholas Koumijian (USA) as new international Co-Prosecutor in the Extraordinary Chambers in the Courts of Cambodia (ECCC).

Trial Chamber to conevene a trial management meeting in Case 002/02

The Trial Chamber of the Extraordinary Chambers of the Courts of Cambodia (ECCC) will convene a trial management meeting in Case 002/02 against Khieu Samphan and Nuon Chea on Wednesday 11 December 2013 at 09:00.  The meeting will continue on Thursday 12 December, and if necessary also on Friday 13 December.The Trial Chamber has notified the parties that the following topics will be discussed during the meeting:

The Court Report for November 2013 issued

The November issue of the Court Report presents an overview of the Closing Statements for Case 002/01, including the visitors' reactions to the hearings. The latest issue also discusses the swearing-in of Mr. Steven J. Bwana, reserve Judge in the Pre-Trial Chamber, and new pledges to the court from Japan, U.K and Cambodia.

Closing statements conclude in Case 002/01

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) concluded 10 days of closing statements in Case 002/01 against Khieu Samphan and Nuon Chea on 31 October 2013. The Chamber will now withdraw for deliberations, and a judgment in this case is expected in the first half of 2014.

Court Report for October 2013 Issued

Registration for Case 002/01 closing statements

The Extraordinary Chambers in the Courts of Cambodia (ECCC) has begun pre-registration for public and media attendance for the Closing Statements in Case 002/01 concerning the accused persons Nuon Chea and Khieu Samphan.The Closing Statements are scheduled to commence on Wednesday 16 October and continue every day except public holidays during the latter half of the month (16, 17, 18, 21, 22, 24, 25, 28, 30 and 31 October) where the parties will make their presentations in the following order: 1)    Statements by Lead Co-Lawyers for Civil Parties (up to 1 day)

ECCC to re-launch radio show on KR Tribunal

A weekly radio talk show on the Khmer Rouge tribunal will be back on air on every Thursday from noon to 1 pm, starting from 19 September, on Bayon FM 95 and its sub-stations nationwide.

Statement by international Co-Prosecutor Andrew Cayley on his resignation

Having tendered my resignation to the Secretary-General of the United Nations in August 2013, I will be leaving the Extraordinary Chambers in the Courts of Cambodia (ECCC) for personal reasons on 16 September 2013. I will join my family who returned home from Cambodia in June 2013.  It is anticipated that the Reserve International Co-Prosecutor, Nicholas Koumjian, will be arriving in Cambodia in October 2013.

Statement on the passing of Mr. Jacques Verges

The Defence Support Section (DSS) of the Extraordinary Chambers in the Courts of Cambodia (ECCC) notes the death, on August 15, 2013, of Mr. Jacques Verges, International Co-Lawyer for the Accused Mr. Khieu Samphan. Mr. Verges died in France at the age of 88 after a long career in criminal defence, representing numerous high-profile clients around the world.

Schedule of closing arguments Case 002/01 adjusted

In a memo issued on 22 August 2013, the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia announced an adjusted schedule for closing submissions in Case 002/01. The deadline for written Closing Briefs by the parties is now extended by one week to 19 September, as the chamber has admitted into evidence about 2,000 more documents since it confirmed the original schedule on 24 July. The hearing of oral Closing Statements is revised to begin on 16 October at 9 am, instead of the previously scheduled date of 9 October.

Governor-General of New Zealand announces new pledge during ECCC visit

The Governor-General of New Zealand, Lt Gen Rt Hon Sir Jerry Mateparae, announced today a new pledge of NZ$ 200,000 to the Extraordinary Chambers in the Courts of Cambodia while visiting the Court to show his country’s support. The pledge was made for the national side of the Court.The Governor-General led a 14-member delegation to the Court during his state visit to Cambodia. This was the first time a leader at the Head of State level had visited the ECCC.

Closing statements in Case 002/01 to commence at 9 October 2013

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has announced that closing statements in Case 002/01 will commence on 9 October 2013 at 9:00, and will go on until 22 October 2013. The Co-Prosecutors have been allocated three days, the Civil Party Lead Co-Lawyers one day and the defence teams for Nuon Chea and Khieu Samphan have been allocated two days each to present their closing statements. One additional day is reserved for rebuttal. The parties have been given until 12 September 2013 to file their written closing briefs. 

Supreme Court Chamber orders second Trial Chamber panel to be explored and dismisses appeals against scope of Case 002/01

On 23 July 2013, the Supreme Court Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) issued a summary of its decision on immediate appeals from the Co-Prosecutors and Nuon Chea against the Trial Chamber’s second decision to sever Case 002 into a series of discrete, smaller trials.

Australia offers new pledge of AU$ 3.25 million

The Government of Australia has made a new pledge for AU$ 3.25 million to the international component of the Extraordinary Chambers in the Courts of Cambodia (ECCC). Australian Minister for Foreign Affairs, Senator Bob Carr announced the new pledge on 18 June 2013. "The ECCC hearings play a vital role in delivering justice for the Cambodian people, who endured unspeakable suffering at the hands of the Khmer Rouge”, Senator Carr said in an official statement.

Kaing Guek Eav transferred to Kandal prison

On 3 February 2012 Kaing Guek Eav was sentenced by the Supreme Court Chamber of the ECCC to a term of life imprisonment.  On the same day the Co-Prosecutors filed a request to enforce sentence pursuant to Rule 113(1) of the Internal Rules.  The Co-Prosecutors requested that:1.    Kaing Guek Eav remain at the ECCC Detention Unit until the conclusion of his scheduled testimony in Case 002; and 2.    Appropriate prison accommodation be identified for Kaing Guek Eav in the national prison system. 

Nuon Chea files immediate appeal against Case 002 Severance Order

Nuon Chea has filed an immediate appeal to the Supreme Court Chamber against the Trial Chamber's Second Decision on Severance of Case 002. The immediate appeal was filed on 27 May 2013, but made public on 4 June 2013.
