Judge CHUNG Chang-ho Appointed as New Pre-Trial Chamber Judge

Following the nomination by the United Nations Secretary General Ban Ki-moon, and the approval by the Supreme Council of the Magistracy, His Majesty King Norodom Sihamoni has appointed Mr. CHUNG Chang-ho (Republic of Korea) as new international judge to serve in the Pre-Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC). Mr. Chung is replacing Judge Catherine Marchi-Uhel who has returned to her post at the International Criminal Tribunal for the Former Yugoslavia. Judge Kathinka Lahuis (Netherlands) will continue as reserve judge.

Case 002 sent for trial

Today, the Pre-Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has confirmed and partially amended the indictments against the Accused Persons Ieng Sary, Ieng Thirith, Khieu Samphan and Nuon Chea. The Pre-Trial Chamber has ordered the Accused Persons to be sent for trial and to continue to be held in provisional detention until they are brought before the Trial Chamber. The indictments include charges of crimes against humanity, genocide, grave breaches of the 1949 Geneva Conventions and murder, torture and religious persecution as defined by the 1956 Cambodian Penal Code.

Conclusion of Judicial Investigation in Case 002

Today, in accordance with Rule 66(1) of the Internal Rules of the Extraordinary Chambers in the Courts of Cambodia (ECCC), the Co-Investigating Judges have notified all the parties and their lawyers that they consider that the judicial investigation in Case 002, in which charges have been laid against Ieng Sary, Ieng Thirith, Nuon Chea, Khieu Samphan and Kaing Guek Eav, has been concluded.

Statement regarding prosecutorial disagreement

The Acting Director of the Office of Administration has in accordance with the applicable provisions in the ECCC law, the Agreement between the Royal Government of Cambodia and the United Nations and the Court’s Internal Rules, forwarded “Considerations of the Pre-Trial Chamber Regarding the Disagreement Between the Co-Prosecutors Pursuant to Internal Rule 71” to the two Co-Prosecutors.

In a Decision rendered today, the Pre-Trial Chamber dismissed two appeals from Khieu Samphan against orders issued by the Co-Investigating Judges, one extending his provisional detention and another rejecting a request for his release.

Pre-Trial Chamber rejects Ieng Sary's Appeal against the extension of provisional detention

In a Decision rendered today, the Pre-Trial Chamber dismissed the Appeal against an Order extending the provisional detention of Ieng Sary and rejected a request from the Charged Person to be put in house arrest as a substitute for detention.
